Chasing a debt in
Victoria.

Every state does this differently. Here's what you need to know if your debtor is in Victoria.

Small claims / tribunal

Magistrates' Court of Victoria (small claims arbitration)

Cap: $10,000
Filing fees: $172–$716

Informal, fast, usually no lawyers needed.

General jurisdiction

Magistrates' Court of Victoria

Cap: $100,000
Filing fees: $545–$1,634

Formal pleadings. Legal costs partly recoverable.

Claims under $10,000 are referred to informal arbitration under s 102 of the Magistrates' Court Act 1989 — Victoria's real small-claims track. VCAT's Civil Claims List is an alternative only for consumer–trader disputes (no legal representation in claims of $15,000 or less without permission), and a VCAT monetary order must be filed with the Magistrates' Court before it can be enforced.
